제13조의2(외국인강사의 채용)
학원설립ㆍ운영자는 외국어교습을 담당하게 하기 위하여 외국인강사(대한민국 국민이 아닌 사람으로서 학원에서 교습을 담당하는 강사를 말한다. 이하 같다)를 채용하려는 경우에는 강사가 되고자 하는 사람으로부터 다음 각 호의 서류를 제출받아 그에 대한 검증 후 채용하여야 한다.
1. 범죄경력조회서
2. 건강진단서(1개월 이내에 받은 것으로서 대마 및 약물 검사 결과를 포함한다)
3. 학력증명서
4. 그 밖에 대통령령으로 정하는 서류
제8조(성범죄 경력 조회 및 회신) ① 영 제25조제1항에 따라 성범죄 경력 조회를 요청하려는 지방자치단체의 장, 교육감, 교육장 또는 법 제56조제1항 각 호에 따른 시설ㆍ기관 또는 사업장(이하 “아동ㆍ청소년 관련기관등”이라 한다)의 장은 별지 제9호서식의 성범죄 경력 조회 신청서(전자문서로 된 신청서를 포함한다)에 다음 각 호의 구분에 따른 서류(전자문서로 된 서류를 포함한다)를 첨부하여 경찰관서의 장에게 제출해야 한다. <개정 2019. 12. 31.>

applicants should apply for a Criminal Records Check Reply (범죄수사경력 회보서) from a police station in Korea.
■ Applicants.
Korean nationals living abroad
Foreign nationals who lived in Korea in the past.
Korean nationals as well as foreigners who currently live in Korea can request this service through local police stations.(tel: +82-2-182)
*They do not accept applications by post.
■ Preparation
Valid Passport and one copy of passport
Copy or proof document of Alien Registration Card(If applicants are foreigners)
* If you can't provide a Copy or proof document of an Alien Registration Card, you should provide us at least your Alien Registration Number.
*Special considerations
Please note that the police certificate must indicate that all records have been searched, including any lapsed records (실효된 형 포함). You should specifically request a search on your entire record, including Criminal Records, lapsed criminal sentences, and investigation records.
1. Employer can get it, print out the agreement file and sign this page and fill out. a signed file would necessarily need to be given to an Employer with your personal details to get a criminal history record.
2. You can get it from the police station where you are located with your passport or ARC card.
3. You can print out yourself, if then you need to ask for a company ID and proof number. (시설기관ID/검증번호)
■ Note;
-You can ask to get a process to your employer by email or check these steps with your employer together.
-Sometimes it takes about 2 hour to get it, please give this form to an employer many days before your arc card expires.
-Sometimes it can happen that the system did not allow it to check your information, if so you need to visit the local police station.

The Korean National Police Agency (KNPA) is providing Background Check (Criminal Records) Certificates(BCC) according to the procedure below.
